Boxyfy Legal Information

Policies and Terms

Please read the following Terms and Conditions, Privacy Policy, Refund and Cancellation Policy, and Delivery Policy carefully before using the Boxyfy website or placing an order.

1. Terms and Conditions 2. Privacy Policy 3. Refund and Cancellation 4. Delivery Policy

1. Terms and Conditions

Terms governing access to the Boxyfy website and orders placed with Boxyfy.

These Terms and Conditions ("Terms") govern your access to and use of www.boxyfy.co.za (the "Website") and any products or services ordered from Boxyfy (Pty) Ltd, registration number 2026/582208/07, a private company incorporated in South Africa with its registered office at 39B Louisa Street, Brackenhurst, Alberton, Johannesburg, Gauteng, 1448 ("Boxyfy", "we", "us", or "our").

By browsing the Website, requesting a quote, or placing an order, you ("you", "the customer") agree to be bound by these Terms. If you do not agree, please do not use the Website or place an order.

1.1 Who we are

Boxyfy is a South African supplier of custom, made-to-order packaging, including boxes, mailers, and related printed packaging materials.

You can reach us at info@boxyfy.co.za or through the contact details published on the Website.

1.2 Quotes, orders and artwork approval

Prices displayed or quoted are estimates until confirmed in writing, as custom packaging pricing depends on specifications such as size, board type, print finish, and quantity.

  • An order is only confirmed once you have accepted a written quotation and, where applicable, approved a digital or physical proof of your artwork or design.
  • You are responsible for the accuracy of all artwork, text, colours, and specifications you submit or approve. Boxyfy is not liable for errors in a design that you approved, including spelling mistakes, incorrect dimensions, low-resolution artwork, or colour variance inherent to the print process.
  • Minor variances in colour, cut lines, and finish between a screen proof and the final printed product are normal in commercial printing and do not constitute a defect.
  • Boxyfy reserves the right to decline any order, including where artwork infringes a third party's rights or is unlawful, offensive, or otherwise objectionable.

1.3 Pricing and payment

All prices are quoted in South African Rand (ZAR) and, unless stated otherwise, exclude VAT and delivery charges, which will be shown separately before you confirm your order.

Production of custom orders will only begin once payment, or the agreed deposit, has been received in full using one of the payment methods made available on the Website or in your quotation.

Boxyfy reserves the right to amend published pricing at any time, but a price quoted and accepted for a specific order will be honoured for that order.

1.4 Minimum order quantities and lead times

Minimum order quantities (MOQs) and production lead times vary by product and are confirmed at the time of quotation. Lead times quoted are estimates from the date artwork is approved and payment is received, and are not guaranteed delivery dates.

1.5 Intellectual property

The Boxyfy name, logo, Website content, and any templates, designs, or artwork created by Boxyfy remain the intellectual property of Boxyfy (Pty) Ltd unless otherwise agreed in writing.

By submitting your own logo, artwork, or branding for use on your packaging, you warrant that you own it or are authorised to use it, and you grant Boxyfy a licence to reproduce it solely for the purpose of manufacturing your order.

You indemnify Boxyfy against any claim arising from artwork you supply infringing a third party's intellectual property or other rights.

1.6 Limitation of liability

To the maximum extent permitted by law, Boxyfy's total liability to you for any claim arising out of or in connection with an order is limited to the amount you paid for that order.

Boxyfy is not liable for any indirect, incidental, or consequential loss, including loss of profits, business, or goodwill.

Nothing in these Terms limits any liability that cannot be excluded or limited under the Consumer Protection Act 68 of 2008 or other applicable law.

1.7 Website use

You agree to use the Website only for lawful purposes and not to interfere with its operation, attempt unauthorised access to any part of it, or use it to transmit unlawful, harmful, or infringing material.

1.8 Governing law

These Terms are governed by the laws of the Republic of South Africa, and any dispute arising from them will be subject to the non-exclusive jurisdiction of the South African courts.

1.9 Changes to these Terms

We may update these Terms from time to time to reflect changes in our business or the law. The version published on the Website at the time you place an order will apply to that order.

1.10 Contact

Questions about these Terms can be sent to info@boxyfy.co.za.

This Privacy Policy explains what personal information we collect through www.boxyfy.co.za, how we use it, and the rights you have in relation to it. Boxyfy is the "responsible party" for personal information processed as described in this policy.

2.1 Information we collect

Depending on how you interact with us, we may collect:

  • Contact details you provide, such as your name, business name, email address, phone number, and delivery or billing address.

  • Communications you send us, such as emails, enquiries, or support requests.
  • Technical information collected automatically when you use the Website, such as IP address, browser type, device information, and pages visited, including through cookies as explained in clause 2.6.

2.2 How and why we use your information

We process personal information for purposes including:

  • Preparing quotations and fulfilling your orders, including production, printing, and delivery.
  • Communicating with you about your order, including proofs, invoices, and delivery updates.
  • Processing payments and preventing fraud.
  • Providing customer support and responding to enquiries.
  • Improving the Website and our products, and complying with our legal, tax, and accounting obligations.
  • Sending marketing communications where you have consented, which you may opt out of at any time.

2.3 Sharing your information

We share personal information only where necessary, including with:

  • Courier and delivery partners, to deliver your order.
  • Payment processors, to process payments securely.
  • Printing and production partners involved in manufacturing your packaging.
  • IT and hosting service providers who support the Website and our systems.
  • Professional advisors, regulators, and law enforcement where required by law.

We do not sell your personal information to third parties. Where a service provider processes personal information on our behalf, we require the service provider to protect it in a manner consistent with POPIA.

2.4 Cross-border transfers

Some of our service providers, for example cloud hosting or email platforms, may store or process information outside South Africa.

Where this occurs, we take reasonable steps to ensure the recipient is subject to a comparable level of data protection, as required by POPIA.

2.5 Security and retention

We implement reasonable technical and organisational measures to protect personal information against loss, unauthorised access, alteration, or disclosure.

We retain personal information only for as long as necessary to fulfil the purposes described in this policy, or as required by law, for example tax and financial record-keeping obligations.

2.6 Cookies

The Website may use cookies and similar technologies to remember your preferences, understand how the Website is used, and improve your experience.

You can control cookies through your browser settings. Disabling cookies may affect how the Website functions.

2.7 Your rights

Subject to POPIA, you have the right to:

  • Be told what personal information we hold about you and request access to it.
  • Request that we correct or update inaccurate or outdated information.
  • Request that we delete or destroy personal information we no longer have a lawful basis to hold.
  • Object to the processing of your personal information in certain circumstances, including direct marketing.
  • Withdraw consent where processing is based on consent, without affecting processing already carried out.
  • Lodge a complaint with the Information Regulator of South Africa if you believe your information has been processed unlawfully.

To exercise any of these rights, contact us at info@boxyfy.co.za.

2.8 Information Regulator

The Information Regulator (South Africa) can be contacted at enquiries@inforegulator.org.za or through the Information Regulator website if you wish to escalate a concern about how your personal information has been handled.

The Website is intended for business and adult use and is not directed at children. We do not knowingly collect personal information from children without the consent of a parent or guardian, as required by POPIA.

Questions, requests, or complaints about this Privacy Policy or your personal information can be directed to our Information Officer at info@boxyfy.co.za.

3. Refund and Cancellation Policy

Refund, cancellation, and defect-reporting terms for custom, made-to-order packaging.

Because Boxyfy manufactures custom, made-to-order packaging to each customer's own specifications and approved artwork, this policy differs from the policy that applies to off-the-shelf, unbranded goods.

This policy should be read together with our Terms and Conditions and is intended to comply with the Consumer Protection Act 68 of 2008 ("CPA").

3.1 Custom orders and the right to return

Under the CPA, the standard consumer right to return goods for a refund because you simply changed your mind does not apply to goods that have been custom-manufactured or produced on special request in accordance with your specifications.

As all Boxyfy packaging is produced to order, once you have approved your proof or artwork and production has begun, we are unable to offer a refund, exchange, or return for change of mind, incorrect quantity requested, or artwork errors that you approved.

3.2 Cancelling an order

  • You may cancel an order and receive a full refund of any amount paid at any time before you have approved a proof and before production has started.
  • If production has already started, cancellation may only be possible for the portion of the order not yet completed. Any costs already reasonably incurred by Boxyfy, including materials, setup, or artwork proofing, may be deducted from any refund.
  • Once an order has been completed and dispatched, the order cannot be cancelled.

3.3 Defective, damaged, or incorrect goods

Your rights are protected where goods are defective, unsafe, do not conform to the specifications and artwork you approved, or do not match the quality you could reasonably expect.

If this happens, please contact us within seven days of delivery with your order number, a description of the issue, and photographs where relevant.

Where a claim is valid, Boxyfy will, at its discretion and in line with the CPA, repair the goods, replace or reprint the goods, or refund the amount paid for the affected goods.

  • This does not cover variances that are a normal feature of the print production process, damage caused after delivery, or issues arising from artwork you approved.

3.4 How refunds are processed

Approved refunds will be processed to the original payment method used, typically within 7 to 14 business days of the refund being approved.

Your bank or payment provider may require additional time to reflect the refund in your account.

3.5 How to request a cancellation or refund

To request a cancellation or report a defective, damaged, or incorrect order, contact us at info@boxyfy.co.za with your order number and details of your request.

4. Delivery Policy

Delivery areas, estimated lead times, costs, tracking, and delivery responsibilities.

This Delivery Policy explains how Boxyfy delivers custom packaging orders placed through www.boxyfy.co.za.

4.1 Delivery areas

Boxyfy delivers nationwide across South Africa through our courier partners. Delivery outside South Africa may be available on request. Please contact us before placing your order to confirm feasibility and cost.

Publishing action required: Confirm and update the specific couriers and areas Boxyfy uses, any areas not covered, and whether international shipping is offered.

4.2 Production and delivery lead times

Because every order is custom-manufactured, the total time to receive your order includes both a production lead time and a delivery or transit time.

  • Production typically takes approximately 5 to 10 working days from the date your artwork proof is approved and payment is received, depending on the product, finish, and order quantity.
  • Delivery or transit time is typically an additional 2 to 5 working days for major centres and may be longer for outlying or rural areas.

These timeframes are estimates and are confirmed with you at the time of quotation. They are not guaranteed and may vary based on order volume, complexity, and courier performance.

Publishing action required: Replace these estimates with Boxyfy's confirmed production and courier transit times before publishing.

4.3 Delivery costs

Delivery costs are calculated based on the size, weight, and destination of your order and will be shown before you confirm and pay for your order.

Publishing action required: Confirm whether Boxyfy offers flat-rate delivery, free delivery above a specified order value, or collection options.

4.4 Order tracking

Where a tracked courier service is used, we will provide you with a tracking number or link once your order has been dispatched so that you can monitor delivery progress.

4.5 Risk and ownership

Risk in the goods passes to you upon delivery to the address you provided. Please inspect your order upon receipt and report any issues in line with clause 3.3 of our Refund and Cancellation Policy.

4.6 Incorrect address and failed delivery

It is your responsibility to provide a complete and accurate delivery address. Boxyfy is not responsible for delays or non-delivery caused by an incorrect or incomplete address supplied by you.

If a delivery fails because no one is available to accept it or the address is inaccessible, additional redelivery costs may apply.

4.7 Delays beyond our control

Boxyfy will not be liable for delivery delays caused by circumstances beyond our reasonable control, including courier disruptions, adverse weather, customs processes, load-shedding, strikes, or other events of force majeure.

We will keep you informed of any significant delay affecting your order.

4.8 Contact

For delivery queries, including tracking requests or delivery issues, contact us at info@boxyfy.co.za with your order number.
